If they're smart, they'll Free the code and put it under the GNU GPL.

Not doing so (aka becoming a singular point of distribution for their
software) makes them a perfect target for the MPAA/RIAA.

Think about it, sue the company -- forcing them to recall all of their
licenses as part of the remediation.  Then anyone who even has the
software is doing so illegally.

Putting the software under the GNU GPL (or, really, any Free Software
license) may not take their names out of it but it would reduce the
chances of their being sued for this because the effectiveness of suing
them would be considerably (majorly) diminished.

What I'm getting at is that people seem to think that just being a
non-centralized p2p solution is enough.  It's not.  It has to be Free
Software as well in order to effectively meet their goals.
