Hello to everybody,
please let me introduce myself: I am a second year student at the Institut
National des Telecommunications in Evry. I belong to the Institut's
association FreeINT, and to the LUG GCU. I only followed two years of
Right courses, one year of general Right, and one year of Telecom and
Computer Rights.
To complete the following message, the treaty of La Hague allows different
parties to sign a single "standard" contract, that fits with the rights
of one country. If there need to be a trial, the contract will be judged
in the country of the contract, and only there. Still, the consequences
will be applied in every country that is concerned by this contract.
Today, this kind of contract are widely use in Finance spheres, when
multiple major corporations are involved. Generaly thoses standard
contracts
are written in English, and under English (for Europe) Legislation.
Recently the "COB" (french institution that regulates stock
exchanges), tried to force these kind of contracts (just the summary in
fact) to be written in French. But because of the "tolé" from many big
international corporations, the COB authorizes today the use of English for
the summary of operations.
Some French corporation are trying to resist (like Credit Lyonnais),
because the contracts are in English, under English Legislation, and
judgeg in England, with consequences in France.
The French government is powerless in this situation.
