I will look on it - it seems like some sort of race condition to me ... i'm not able to recreate the problem on Linux, FreeBSD, OpenBSD, nor Solaris => it seems that there are some special conditions.

Can you send me your monit configuration file?

Was monit re-compiled after the upgrade or was it your old compile ?
