+<h2>DRM dans les livres scolaires électroniques<br /> <span
+style="font-size:.6em">Quand la réalité imite les récits
dystopiques</span></h2>

+<p>Il semble toujours surréaliste de rencontrer des situations un petit peu
+trop proches d'une chose qu'on a lue. C'est même pire lorsqu'on réalise que
+ce qu'on a lu est une dystopie nous alertant sur les dangers que la rapacité
+des entreprises fait courir aux élèves et étudiants.</p>
+
+<p>En février 1997, le magazine <cite>Communications of the <abbr
+title="Association for Computing Machinery">ACM</abbr></cite> a publié <i
+lang="en">«â¯The Right to Readâ¯Â»</i> (<a
+href="/philosophy/right-to-read.html">Le droit de lire</a>) de Richard
+M. Stallman, récit édifiant d'un avenir où les éditeurs et le gouvernement
+se livrent à une répression massive de la prétendue «â¯piraterieâ¯Â».</p>
+
+<p>Dans «â¯Le droit de lireâ¯Â», une étudiante de licence nommée Lissa
Lenz a un
+souci. Son ordinateur, qui contient tous ses manuels et lui est
+indispensable pour préparer son partiel, tombe en panne. Elle demande à son
+ami Dan Halbert de lui prêter le sien. C'est un gros problème pour Dan. Si
+d'aventure Lissa lisait ses livres, il serait arrêté par la SPA (une agence
+gouvernementale créée afin de combattre le partage) pour violation du droit
+d'auteur et se verrait coller l'étiquette de délinquant. Finalement, par
+solidarité envers son amie, il fait l'impensableâ¯: il donne à Lissa son mot
+de passe pour essayer de cacher à la SPA la violation du droit d'auteur, et
+de ce simple fait se met en infraction.</p>
+
+<p>Dans cette nouvelle, Stallman prédisait des tas de vilaines
+choses. Malheureusement, elles se sont toutes vérifiées. «â¯Le droit de
+lireâ¯Â» n'est plus un scénario hypothétique, ce n'est plus une petite
+histoire pour nous mettre en garde contre un avenir possible.</p>
+
+<p>C'est notre <em>présent</em>.</p>
+
+<h3>Que veut dire «â¯DRMâ¯Â»â¯?</h3>
+
+<p>DRM est un acronyme qui est censé signifier <i lang="en">Digital Rights
+Management</i> (gestion numérique des droits), mais en pratique il est plus
+juste de dire qu'il signifie <i lang="en">Digital Restrictions
+Management</i> (gestion numérique des restrictions). Il désigne tout moyen
+de contrôler les Åuvres et le matériel privateurs couverts par le droit
+d'auteur. Son but est de restreindre ce que peuvent faire les
+utilisateurs. DRM est un terme générique pour différents outils visant Ã
+atteindre ce but, tels que des accords juridiques (c'est la technique
+utilisée par le desservice en question), ou des logiciels malveillants
+cherchant à empêcher des actions particulières â par exemple, empêcher
les
+utilisateurs de se connecter par le réseau TOR ou à l'extérieur d'une
+certaine zone géographique (Irlande dans mon cas). Vous trouverez des
+exemples de gestion numérique des restrictions sur la page «â¯<a
+href="/proprietary/proprietary-drm.html">DRM du logiciel
privateur</a>â¯Â».</p>
+
+<h3>Une rencontre dans la vie réelle avec l'illégalité</h3>
+
+<p>Au cours de mes études secondaires, j'ai été contacté par un ami qui
avait
+des difficultés à étudier parce qu'il s'était mis dans le pétrin en
laissant
+ses livres de classe dans son casier pendant des petites vacances. Stupide
+erreur mise à part, je n'ai pas hésité à lui prêter une version modifiée
de
+mon mot de passe pour qu'il puisse accéder à mes exemplaires des livres
+électroniques, hébergés sur le site de l'éditeur (le «â¯serviceâ¯Â»).
Cela lui
+a permis de préparer les examens qui approchaient, et d'être reçuâ¯; pas de
+problème. J'étais loin de me douter que, d'après les conditions
+d'utilisation de ce desservice, je venais de commettre l'acte le plus vil,
+le plus méprisable qu'un être humain puisse commettreâ¯: aider mon ami â
un
+acte de «â¯piraterieâ¯Â», aux yeux des éditeurs.</p>
+
+<p>Les conditions d'utilisationâ¯<a href="#terms" id="terms-rev">[2]</a> de ce
+desservice sont un peu difficiles à trouver, ce qui donne l'impression que
+l'éditeur n'est pas digne de confiance. Elles ne sont pas accessibles
+facilement sur la page de connexion ni sur la page d'accueil de la
+bibliothèque, mais au contraire cachées dans la section Aide. Je ne vais pas
+les citer textuellement, mais elles interdisent explicitement le partage des
+mots de passe. Elles contiennent aussi plusieurs autres choses qui valent la
+peine d'être relevées et que j'aborderai plus tard.</p>
+
+<p>Les conditions d'utilisation sont extrêmement claires sur un pointâ¯: vous
+n'êtes nullement autorisé à partager ce livre électronique, d'aucune
manière
+et en aucune circonstance.</p>
+
+<p>Mettons une chose au point. Je ne possède pas vraiment ce livre
+électronique. La version physique du livre affiche fièrement sur sa
+couverture un avis disant que l'achat incluera une version numérique. Au
+mieux, c'est trompeur. Ce qu'on me fournit est une licence limitée dans le
+temps pour accéder au contenu du livre, sur la plateforme privatrice de
+l'éditeur exclusivement. Je ne peux pas le télécharger pour en avoir une
+copie locale lisible hors ligne parce que l'éditeur prétend qu'elle est
+«â¯trop volumineuseâ¯Â» pour tenir sur un support amovible, en ignorant le
fait
+que je la veux seulement sur mon disque dur. J'ai décidé de regarder si
+cette allégation était fondée et ai découvert que, tout compris, la taille
+du livre électronique était même inférieure de plusieurs ordres de grandeur
+à la capacité d'un CD réinscriptible. Sommes-nous censés croire que la
+raison pour laquelle on ne peut pas télécharger de copie d'un livre
+électronique est qu'elle ne tient pas sur un support amovible� à mon avis,
+la vraie raison pour laquelle ils ne veulent pas que les gens téléchargent
+est la prévention du partage.</p>
+
+<h3>Restrictions habituelles</h3>
+
+<p>à l'endroit où j'habite en Irlande, certaines nouvelles écoles utilisent
des
+iPads (qui ont eux-mêmes <a href="/proprietary/malware-apple.html">une foule
+de problèmes d'éthique et de vie privée</a>) dans le but de transférer tous
+les livres de leurs élèves vers ces «â¯servicesâ¯Â». Parmi les avantages,
on
+cite fréquemment la réduction du poids des cartables, la facilité
+d'organisation et la capacité multimédia. Tout ceci est vrai, mais ce qu'on
+néglige souvent, c'est que la migration vers des appareils numériques
+nécessite que les élèves acceptent les conditions d'utilisation imposées
par
+les éditeurs. Ces conditions restreignent leurs possibilités d'explorer, de
+chercher et d'<em>apprendre</em>.</p>
+
+<p>Les livres électroniques de ces plateformes ont également un tas
+d'inconvénients pratiques. Ils doivent être utilisés avec une connexion
+permanente à Internet, qui dans de nombreuses écoles sera difficile Ã
+maintenir en état. Ils ne peuvent pas être téléchargés, donc les élèves
qui
+n'ont pas facilement accès à Internet se retrouveront de fait privés de
+livres. Ils ne sont peut-être pas utilisables sur tous les appareils, ou
+sont peut-être restreints à un seul système d'exploitation ou un seul
+navigateur. L'inconvénient le plus grave, probablement, est qu'on ne peut
+les obtenir qu'à un endroit centralisé, dont l'accès est autorisé
uniquement
+à la personne qui les a payés, autorisation qui peut être retirée après un
+temps limité. Pourriez-vous imaginer qu'un éditeur vienne à votre remise de
+diplôme et, sans mot dire, vous reprenne brusquement vos livres physiques�
+Image stupide, ridicule… mais c'est ce qui arrive avec les livres
+électroniques.</p>
+
+<p>Quand les écoles utilisent des livres physiques, les élèves ont au moins
+l'option de les acheter d'occasion ou de récupérer ceux d'un ami, d'un frère
+ou d'une sÅur. Si le code d'accès aux livres électroniques continue à être
+fourni par un seul éditeur centralisé, nous risquons de voir s'établir un
+monopole où les manuels nécessaires à notre enseignement gratuit sont rendus
+inabordables par un prix prohibitif. Nous risquons de nous retrouver devant
+une situation comme celle de Texas Instrument, où une entreprise ayant une
+mainmise sur l'enseignement peut exiger des prix astronomiques sans avoir
+besoin d'innovation ni de mise à jour. Texas Instruments a acquis cette
+position en faisant pression pour être acceptée comme norme éducative par le
+<i lang="en">National Council of Teachers of Mathematics</i> (Conseil
+national des enseignants de mathématiques). Une fois reconnue comme telle,
+elle s'est mise à abuser de sa position en refusant de réduire le prix de
+ses calculatrices alors qu'elles devenaient de moins en moins chères Ã
+produire année après année. Cela assure à l'entreprise des marges
+bénéficiaires brutes atteignant 90â¯%, tout en rendant très difficile pour
+les familles à faible revenu de faire faire des études à leurs enfants.</p>
+
+<p>Les élèves n'ont pas grand chose à dire sur les plateformes qu'ils sont
+obligés d'utiliser. Il est possible que l'école leur donne une adresse de
+courriel fournie par Microsoft Office 365 et exige qu'ils consentent aux
+conditions imposées par l'éditeur. Il est possible que les élèves aient
+besoin de livres provenant de différents éditeurs et soient obligés
+d'accepter plusieurs contrats. Et même s'ils acceptent une version donnée du
+contrat, la plupart des éditeurs se réservent le droit de la
+modifier. Peut-être â comme je l'ai découvert dans les conditions du
+desservice que j'ai mentionnées plus haut â que l'éditeur se réserve le
+droit de facturer ultérieurement des frais pour accéder aux livres. Est-ce
+que les élèves ont vraiment le choix� Pas actuellement. à moins d'un
+changement, ils n'ont pas le choix. Ils sont forcés d'accepter les
+conditions, quoi qu'ils en pensent, sinon ils perdent leur possibilité
+d'apprendre en perdant leurs livres.</p>
+
+<h3>Contestation des présupposés</h3>
+
+<p>Certains pourraient dire que ces conditions sont raisonnables, que les
+élèves n'ont pas le droit de chercher à savoir comment fonctionnent les
+outils qu'ils utilisent pendant leur scolarité, ni de partager cette
+information avec leurs pairs.</p>
+
+<p>Auriez-vous une objection si une élève lisait un de ses livres scolaires
+pendant des vacances en France� Si elle le lisait pendant un voyage en
+Irlande du Nord� Dans un bus� Dans une bibliothèque publique�</p>
+
+<p>Bien sûr que non.</p>
+
+<p>Auriez-vous une objection si, disons, un élève prêtait une copie de son
+livre à un ami� S'il permettait à une personne assise près de lui de le
+regarder� Si un élève copie une phrase d'un livre dans son cahier, est-ce
+un voleur ou un pirate� Est-ce que le professeur doit le dénoncer pour
+activité illégale�</p>
+
+<p>Bien sûr que non.</p>
+
+<p>Qu'en est-il si l'élève demande comment le livre a été relié�
Comment le
+papier a été fabriqué� Avec quoi on a fabriqué l'encre� Comment
fonctionne
+le processus d'écriture� Comment les livres sont livrés aux libraires pour
+la vente� Est-ce que cet élève doit être puni pour avoir essayé de se
+renseigner sur les techniques d'édition�</p>
+
+<p>Bien sûr que non.</p>
+
+<p>Et enfin, auriez-vous une objection si les élèves revendaient leurs
manuels
+scolaires quand ils n'en ont plus l'usage� S'ils donnaient leurs notes,
+rédigées à partir de l'information contenue dans un livre, à d'autres
+élèvesâ¯? Diriez-vous que les élèves ne doivent pas être autorisés Ã
donner
+leur livre si l'une des lignes est rayée et réécrite�</p>
+
+<p>Bien sûr que non.</p>
+
+<p>Mon ami a fait un résumé parfaitement adéquatâ¯: «â¯C'est comme si
[les
+systèmes scolaires] mettaient les droits des entreprises au-dessus des
+droits des élèves.â¯Â»</p>
+
+<p>Dans le paysage actuel où les établissements d'enseignement projettent
+d'introduire les nouvelles technologies, nous devons être prudents. Sans
+examen et action appropriés, nous pourrions nous retrouver dans une réalité
+encore plus proche de celle que décrit «â¯Le droit de lireâ¯Â». Les
commissions
+scolaires ont déjà commis des erreurs par le passé, comme avec Texas
+Instruments. J'exhorte chacun à faire pression contre ce genre de conditions
+d'utilisation. Voici quelques pistesâ¯:</p>

+demander à votre école de prendre en compte les conditions d'utilisation des
+services de livres électroniques et exiger que ces derniers soient exempts

+<h2>DRM In School eBooks: When Life Imitates Dystopian Stories</h2>

+<p>It always feels surreal to come across situations that are just a little
+too close to something you've read. It's even worse when you realize that
+something you've read is a dystopian story warning about the dangers of
+corporate greed and abuse of students.</p>
+
+<p>In February 1997, the magazine <cite>Communications of the
+<abbr title="Association for Computing Machinery">ACM</abbr></cite>
+published Richard M. Stallman's <a href="/philosophy/right-to-read.html">
+<cite>The Right to Read</cite></a>, a cautionary tale of a future where
+publishers and the government crack down on so-called
“piracy” <a
+href="#piracy" id="piracy-rev">[1]</a> to a massive extent.</p>
+
+<p>In <cite>The Right to Read</cite>, a college student named Lissa Lenz has
+an issue. Her computer, which contains all her textbooks and is the only
+tool for writing her midterm project, breaks down. She asks her friend Dan
+Halbert to borrow his computer. This is a big problem for Dan. If Lissa were
+to read his books, the SPA—a government agency created to combat
+sharing—would arrest him for copyright infringement and brand him
+a criminal. In the end, out of concern for his friend, he does the
+unthinkable: he gives Lissa his password in an attempt to hide the copyright
+infringement from the SPA, breaking the law with that simple act.</p>
+
+<p>Stallman predicted a lot of bad things in that piece of fiction. Sadly,
+they have already come true. <cite>The Right to Read</cite> is no longer
+a hypothetical scenario, no longer just a story warning about a possible
+future.</p>
+
+<p>It is our <em>present</em>.</p>
+
+<h3>What is DRM?</h3>
+
+<p>DRM is an initialism which is supposed to stand for
+“Digital Rights Management,” but in practice it's more accurate
+to say it stands for “Digital <em>Restrictions</em> Management.”
+It refers to any means used to control copyrighted and proprietary digital
+works and hardware. Its purpose is to restrict what users can do. DRM is an
+umbrella term for various tools aimed at achieving that goal, such as legal
+agreements (which is the technique the dis-service in question is using),
+or malware that seeks to prevent specific actions. For example, to prevent
+users from connecting to a website through the TOR network or from outside
+of a certain geographical area (Ireland, in my case). For some examples of

+href="/proprietary/proprietary-drm.html">proprietary DRM</a>.”</p>
+
+<h3>A Real-Life Encounter With Becoming Illegal</h3>
+
+<p>During the course of my secondary school education, I was contacted by a
+friend who was finding it difficult to study because he had managed to mess
+things up by leaving his textbooks in his locker over a mid-term break.
+Silly mistake aside, I thought nothing of lending him a modified version of
+my password so that he could access my copies of the ebooks, hosted at the
+publisher's platform (the “service”). He'd be able to
+study and pass the upcoming exams, no harm done. Little did I know that,
+according to the terms and conditions of the dis-service, I had just
+committed the most vile, despicable act a human being could commit:
+help my friend—or, in the eyes of the publisher,
+“piracy.”</p>
+
+<p>The terms and conditions <a href="#terms" id="terms-rev">[2]</a>
+of the dis-service are somewhat hard to find, which makes one feel the
+publisher is untrustworthy. They are not readily available on the login page
+or on the main library page; instead, they are hidden in the help section.
+I won't quote them exactly, but they do expressly forbid the sharing of
+passwords. They also contain several other things worth noting, which I will
+discuss later.</p>
+
+<p>The terms and conditions are very, very clear about one thing: you're not
+allowed to share the ebook in any way, with any means, under any
+circumstances.</p>
+
+<p>Let me clear up one thing. I don't actually own the ebook. The physical
+version of the book proudly displays a notice on the cover saying you'll get
+a free ebook version along with your purchase. That's misleading, at best.
+What I get is a time-limited license to access its contents, exclusively on
+the publisher's proprietary platform. I can't download it to get a local
+copy to read offline because the publisher claims it's “too big”
+to fit in removable media, ignoring the fact that I may just want it on my
+hard drive. I decided to see if the claim was true and found that the grand
+total size of the ebook came in orders of magnitude lower than even the
+capacity of a CD-R disc. Are we really to believe the reason we can't
+download a copy of a digital book is that it can't fit in removable media?
+In my opinion, the real reason they don't want people to download copies is
+to prevent sharing.</p>
+
+<h3>Common Restrictions</h3>
+
+<p>Some new schools where I live in Ireland are using iPads (which have a
+whole host of <a href="/proprietary/malware-apple.html">privacy and ethical
+concerns</a> in and of themselves) with the goal of moving all their students'
+books to these online “services.” Benefits cited often include
+reduced weight in students' bags, ease of organization, and multimedia
+capabilities. All of which are true, but what is often neglected is that the
+move to digital devices requires students to agree to terms of service
+imposed by companies. These terms restrict students' ability to explore,
+research, and <em>learn</em>.</p>
+
+<p>There are also a lot of practical downsides to ebooks on these platforms.
+They have to be used with a constant connection to the Internet, which will
+be difficult for many schools to maintain. They can't be downloaded, so
+students who don't have easy access to the Internet will be essentially
+stuck with no books. They may not be supported on all devices, or may be
+restricted to a single operating system or browser. Probably the biggest
+downside is that they can be obtained only from one centralized location,
+with authorized access granted only to the person who paid for it, and taken
+away after a limited time. Could you imagine a company coming to your
+graduation and wordlessly snatching your physical books back? A silly,
+ridiculous image, but it's what happens with ebooks.</p>
+
+<p>When schools use physical books, students at least have the option of
+buying them second-hand, or getting them handed down from a friend or a
+sibling. If the practice of getting an ebook access code from a single
+centralized publisher continues, we may see a publisher's monopoly
+where textbooks needed for our free education are held away from us with a
+massive price tag. We may end up with a situation like Texas Instruments,
+where a company with a stranglehold on education can charge astronomical
+prices without the need to innovate or upgrade. Such a position was gained
+by pushing themselves as the educational standard in the National Council of
+Teachers of Mathematics. Once established as such, the company began to
+abuse its position by refusing to reduce the price of their calculators as
+they become cheaper to manufacture year after year. This leaves the company
+with gross profit margins of up to 90 percent, all the while making it very
+difficult for lower income families to educate their children.</p>
+
+<p>Students don't have much of a say about which platforms they'll be
+required to use. The school may give them an email address, provided by
+Microsoft Office 365, and require them to agree to the terms imposed
+by the publisher. Students may need books from different publishers, and may
+have to agree to multiple contracts. And even if they do agree to a given
+version of a contract, most publishers reserve the right to change it.
+Perhaps the publisher might—as I discovered in the terms of the
+dis-service I mentioned earlier—reserve the right to later charge fees
+to access the books. Do the students really have a choice? Not at the moment.
+Unless something changes, they don't have a choice. They're forced to accept
+the terms, no matter what they think of them, otherwise they lose their
+chances for education by losing their books.</p>
+
+<h3>Challenging the Assumptions</h3>
+
+<p>Some may say that these terms are reasonable, that students aren't
+entitled to learn how the tools they use during their education work, or
+to share information with their peers.</p>
+
+<p>Would you object to a student reading her schoolbook while on holidays in
+France? If she reads it while traveling to Northern Ireland? On a bus? In a
+public library?</p>
+
+<p>Of course not.</p>
+
+<p>Would you also object to, say, a student lending a copy of his book to a
+friend? Allowing someone sitting next to him to look at his book? If a
+student copies a sentence from a book into his notes, is he a thief or a
+pirate? Should the teacher report him for illegal activity?</p>
+
+<p>Of course not.</p>
+
+<p>And what if the student were to ask how the book was bound? How the paper
+was made? What the ink was made up of? How the process of writing works? How
+they are delivered to bookstores to be sold? Should this student be punished
+for attempting to learn about the publisher's techniques?</p>
+
+<p>Of course not.</p>
+
+<p>And finally, would you object to students selling their textbooks when
+they no longer have a need for them? To giving away their notes, made using
+information from the book, to other students? Would you say students
+shouldn't be allowed to give away their book if it has a line crossed out
+and rewritten?</p>
+
+<p>Of course not.</p>
+
+<p>My friend made quite an apt summary: “It's like [school systems] put
+the rights of companies over the rights of the students.”</p>
+
+<p>With the current landscape of educational institutions planning to
+introduce new technologies, we need to be careful. Without proper
+consideration and action, we may find ourselves in a reality even closer to
+the one described in <cite>The Right to Read</cite>. School boards have
+already made mistakes in the past, like with Texas Instruments. I would urge
+everyone to start pushing against this sort of terms. Here are some
+suggestions:</p>
+
+<ul>
+<li>During the decision process about which textbooks to use, you could
+petition your school to consider the terms and conditions of ebook
+services and make it a requirement that ebooks be DRM-free and
+downloadable.</li>
+
+<li>You could start the preparation of a textbook for your local
+curriculum and publish it under a free license such as the <a
+href="/licenses/licenses.html#FDL">GNU Free Documentation License</a>,
+<a
+href="https://creativecommons.org/licenses/by-sa/4.0/">CC BY-SA</a>, or
+similar.</li>
+
+<li>Support the FSF's <a
+href="https://www.defectivebydesign.org/ebooks.html">campaign</a> to
+abolish eBook DRM.</li>
+</ul>
+
+<p>Let's make sure schools don't punish learning. </p>
+
+<p>Let's make sure <a href="/philosophy/ebooks-must-increase-freedom.html">
+ebooks increase our freedom, not decrease it</a>.</p>
