+<p>Å ikana ze strany vlastnÃků autorských práv podnÃtila ve Å védsku
vznik
+prvnÃpolitické strany, jež má ve vÃnku redukci ochrany autorských práv;
+Pirátskoustranu. Mezi jejÃmi tezemi můžeme najÃt: zákaz správy
digitálnÃch
+práv(digital restrictions management - DRM), legalizaci nekomerÄnÃho
sdÃlenÃ
+publikovaných pracà a zkrácenà doby platnosti autorských práv pÅi
komerÄnÃm
+užità na pÄt let. Po pÄti letech od vydánÃ, by se každá publikovaná
práce
+stalasouÄástà veÅejné domény (public domain).</p>
+
+<p>ObecnÄ ÅeÄeno: tyto zmÄny podporuji. Ironicky, podoba tÄchto zmÄn
+zvolenášvédskou Pirátskou stranou podkopává svobodný software. Jsem si
jist,
+ženezamýšleli svobodný software poÅ¡kodit, pÅesto je to to, co by se
stalo.</p>
+
+<p>GNU General Public License a ostatnà copyleftové licence použÃvajÃ
+autorsképrávo k obranÄ svobody každého uživatele. GPL vÅ¡em povoluje
+Å¡ÃÅenÃupravených pracÃ, ale pouze pod tou samou licencÃ. Å ÃÅenÃ
nepozmÄnÄné
+prácetaktéž vyžaduje zachovánà licence. StejnÄ tak vÅ¡ichni Å¡iÅitelé
+musÃuživatelům umožnit pÅÃstup ke zdrojovému kódu softwaru.</p>
+
+<p>Jak by tedy základnà teze švédské Pirátské strany postihly svobodný
+softwarepod copyleftovou licencÃ? Za pÄt let by jejich zdrojové kódy se
+stalysouÄástà veÅejné domény a vývojáÅi proprietárnÃho softwaru by
ho
+mohlizaÄlenit do svých programů. A jak že to vypadá v pÅÃpadÄ
opaÄném?</p>
+
+<p>Proprietárnà software je omezený licenÄnÃm ujednánÃm pro koncového
+uživatele(EULA), tedy nejen autorským právem, a uživatelé navÃc nemajÃ
jeho
+zdrojovýkód. I pokud by autorské právo povolovalo nekomerÄnà sdÃlenÃ,
EULA
+ho můžezakazovat. NavÃc: uživatelé, nemajÃce zdrojové kódy, nemajÃ
vliv na
+to, coprogram dÄlá, když ho spustÃ. SpouÅ¡tÄnÃm takového programu se
své
+svobodyvzdáváte a pÅenecháváte vývojáÅi vládu nad sebou samými.</p>
+
+<p>Jaký následek by mÄlo ukonÄenà autorských práv k programu po
uplynutà pÄti
+let?SouÄasný návrh by nevyžadoval, aby vývojáŠuvolnil zdrojový kód,
a dá se
+pÅedpokládat, že vÄtÅ¡ina by to dobrovolnÄ ani nikdy
+neudÄlala. Uživatelům,poÅád bez pÅÃstupu ke zdrojovému kódu, by nebylo
+umožnÄno použÃvat programve svobodném duchu. Program by dokonce mohl mÃt
+„Äasovanoubombu“, která by zajistila, že po pÄti letech
pÅestane
+fungovat; v tompÅÃpadÄ by kopie ve „veÅejné doménÄ“ vůbec
+nefungovaly.</p>
+
+<p>Tedy, podle návrhu Pirátské strany by za pÄt let vývojáÅi
+proprietárnÃhosoftwaru dostali k využità kód pod GPL, ale vývojáÅi
+svobodného softwaruby na oplátku nedostali kód proprietárnÃ; ne za pÄt
+dokonce let ani za padesátlet ne. Svobodný svÄt by dostal to Å¡patné, ale
ne
+to dobré. RozdÃl mezizdrojovým kódem a objektovým kódem na stranÄ
jedné a
+praxà v použÃvánÃlicenÄnÃch ujednánà pro koncového uživatele na
stranÄ druhé
+by, dal proprietárnÃmu softwaru faktickou výjimku ze vÅ¡eobecného pravidla
o
+pÄtiletéochranÄ autorských práv — tu by ale svobodný software
+nesdÃlel.</p>
+
+<p>V neposlednà ÅadÄ použÃváme autorské právo k ÄásteÄnému
odstÃnÄnÃ
+nebezpeÄÃsoftwarových patentů. Nedokážeme zajistit, že naÅ¡e programy
jsou od
+problémůs nimi spojenými oproÅ¡tÄné (v zemi, která je zavede, nebude
nikdy
+žádnýprogram v bezpeÄÃ), ale alespoÅ patentům zabraÅujeme, aby udÄlaly
+program fakticky nesvobodným. Å védská Pirátská strana navrhuje zruÅ¡enÃ
+softwarových patentů, a pokud by se tak i stalo, tento problém by
+zmizel. Ale dokud toho dosaženo nenÃ, nesmÃme ztratit naÅ¡i jedinou obranu
+pÅed patenty.</p>
+
+<p>Když švédská Pirátská strana oznámila své základnà teze,
vývojáÅi
+svobodnéhosoftwaru si vÅ¡imli tohoto následku a zaÄali navrhovat zvláštnÃ
+pravidlo prosvobodný software - pro ten by autorské právo trvalo déle,
takže
+by mohlo dálepokraÄovat v Å¡ÃÅenà pod copyleftem. Tato výslovná
výjimka pro
+svobodnýsoftware by vyvážila onu faktickou výjimku pro proprietárnÃ
+software.MyslÃm, že i jenom desetiletá výjimka by mÄla staÄit. AvÅ¡ak
tento
+návrh sesetkal s odporem u lÃdrů Pirátské strany, kteÅà se stavÄli
proti
+ideji delÅ¡Ãplatnosti autorského práva v nÄjakém speciálnÃm
pÅÃpadÄ.</p>
+
+<p>Dokázal bych podpoÅit právnà úpravu, která by po uplynutà pÄti let
+zajistilauvolnÄnà zdrojového kódu GPL softwaru do veÅejné domény pod
+podmÃnkou, že tosamé bude platit pro proprietárnà zdrojový kód. Konec
konců
+copyleft je jenprostÅedek vedoucà ke konci – svobodÄ
+uživatelů – ne koncem samotným. A osobnÄ bych nerad obhajoval
+silnÄjÅ¡Ã ochranu autorských práv.</p>
+
+<p>Takže jsem navrhl, aÅ¥ programové teze Pirátské strany požadujÃ, aby v
+dobÄuvolnÄnà binárnÃch souborů byl zdrojový kód vydán “do
+úschovy”.Takto “uschovaný” zdrojový kód by mohl být po
+pÄti letech uvolnÄn do veÅejné domény. SpÃÅ¡e než dÄlat ze svobodného
+softwaru oficiálnà výjimku v pÄtileté ochranÄ autorských práv, toto by
+eliminovalo neoficiálnà výjimku proprietárnÃho softwaru. AÅ¥ tak Äi onak,
+výsledek je férový.</p>
+
+<p>Jeden pÅÃvrženec Pirátské strany navrhl obecnÄjÅ¡Ã variantu onoho
prvnÃho
+návrhu: obecné schéma, dÃky kterému autorská práva trvajà déle, pokud
je
+veÅejnosti dáváno vÃce svobody pÅi využÃvánà dané práce. Výhoda
+tohotopÅÃstupu je ta, že svobodný software se stává obecnÄjÅ¡Ãho
Å¡irÅ¡Ãho
+proudu pracà se vzájemnÄ se liÅ¡ÃcÃmi licencemi a ne osamÄlou
výjimkou.</p>
+
+<p>Preferoval bych ÅeÅ¡enà “úschovou”, ale jakákoliv z tÄchto
metod
+by pÅedeÅ¡la specifickému pÅedpojatému úÄinku proti svobodnému
+softwaru. Můžou zde být i dalÅ¡Ã ÅeÅ¡enÃ, která by mohla být stejnÄ
dobrá,
+jako ta už zmÃnÄná. AÅ¥ tak Äi onak, Å¡védská Pirátská strana by
mÄla pÅedejÃt
+uvalenà hendikepu na hnutà ochraÅujÃcà veÅejnosti pÅed záškodnickými
obry.</p>
