+y otros esquemas que permiten construir música: contenedores de significado,
+disponibles para que cualquiera los use, libres de restricciones. No deberÃa
+preocuparse por las consecuencias de distribuir su material en el formato
+MP3, asà como tampoco se preocuparÃa en poner el número de página en el
+borde superior de una página o en comenzar un libro con un Ãndice de
+contenidos.</p>
+
+<p>Desafortunadamente, no es asà en el mundo en que vivimos. El MP3 es un
+formato patentado. Lo que significa que diversas compañÃas tienen monopolios
+garantizados por el gobierno sobre ciertos aspectos del estándar MP3, como
+que siempre que alguien cree o escuche un archivo MP3, <em>aún con software
+que no haya sido escrito por una de esas compañÃas</em>, tienen el derecho a
+decidir si permiten o no el uso del MP3. TÃpicamente, lo que hacen es exigir
+dinero, por supuesto. Pero los términos están enteramente a su merced: si
+asà lo quisieran, podrÃan prohibirle usar MP3 totalmente. Si ha estado

+<p>AquÃ, el daño va más allá que sólo el daño que le causan. Una patente
de
+software garantiza a una de las partes el derecho exclusivo a usar un cierto
+hecho matemático. Este derecho puede ser comprado y vendido, incluso
+litigado como una porción de propiedad, y nunca se puede predecir qué podrÃa
+hacer con ella su nuevo dueño. Esta no es sólo una posibilidad abstracta:
+las patentes de MP3 han sido sujeto de múltiples demandas, con
+compensaciones que totalizan más de un billón de dólares.</p>
+
+<p>La cuestión más importante aquà no son las regalÃas, sino la libertad de
+comunicarse y de desarrollar herramientas de comunicación. Los formatos de
+distribución como el MP3 son los contenedores del intercambio de información
+en Internet. Imagine por un momento que alguien tuviese una patente de la
+vibración modulada de las moléculas de aire: necesitarÃa una licencia sólo
+para mantener una conversación o tocar la guitarra para una
+audiencia. Afortunadamente, nuestro gobierno [el de los EE.UU.] ha mantenido
+durante largo tiempo esos viejos y familiares métodos de comunicación, como
+las vibraciones de las moléculas de aire o la escritura de sÃmbolos en
+pedazos de papel, no patentables: nadie puede ser su dueño, son libres de
+usar por cualquiera. Pero hasta que esas mismas libertades se extiendan a

+<h4 class="sec">Una salida: El formato Ogg Vorbis</h4>
+
+<p>Ogg Vorbis es una alternativa al MP3. Obtiene una calidad de sonido alta,
+puede comprimir a un tamaño menor que MP3 manteniendo un buen sonido (por lo
+que le ahorra tiempo y costos de ancho de banda); y lo mejor de todo, está
+diseñado para ser completamente libre de patentes.</p>
+
+<p>No sacrificará ninguna calidad técnica codificando su audio en Ogg
+Vorbis. Los archivos suenan bien, y muchos reproductores saben cómo
+interpretarlos. Pero hará que se incremente el número total de personas que
+pueden escuchar sus pistas, y al mismo tiempo ayuda a la promoción de los
+estándares libres de patentes para los formatos de distribución.</p>

+segura, para usted y sus oyentes, serÃa ofrecer exclusivamente archivos Ogg
+Vorbis. Pero como todavÃa existen algunos reproductores que sólo pueden
+trabajar con MP3, y no quiere perder audiencia, un primer paso es ofrecer
+tanto Ogg Vorbis como MP3, explicando a los que descarguen (tal vez
+enlazando a este artÃculo) por qué exactamente usted apoya a Ogg Vorbis.</p>

+<p>Y con Ogg Vorbis, incluso <em>ganará</em> algo de audiencia. Aquà el
cómo:</p>

+<p>Hasta este momento, los dueños de las patentes de MP3 han sido lo
+suficientemente inteligentes como para no hostigar a los usuarios
+individuales con exigencias de pagos. Saben que eso estimularÃa la
