Yes, this problem is not from api_msg, but from raw api (so, in all api layer).
I'm agree if we add check it inside tcp_listen (but which state check exactly?)

That leaves us with a todo: check state of tcp_pcb given to tcp_listen (state
must be closed or else it won't be on tcp_bound_pcbs but on another list)!
