Actually, the latest version linked from the Gnome wiki was not the latest 
version of
the 2.x branch.

It's this:

https://launchpad.net/gnome-icon-theme/main/2.91.93/+download/gnome-icon-theme-2.91.93.tar.gz

Released in 2011.

It has an updated COPYING saying:

"GNOME icon theme is distributed under the terms of either GNU LGPL v.3
or Creative Commons BY-SA 3.0 license."


So they should be asked to change it to "GNU LGPL v.3 and later" and then I 
guess Emacs
can use it.
