Problems with last Emacs-23.0.60-CVS on Cygwin?

After building last CVS (-D "2008-03-30 10:00"), when Emacs is started as

emacs -nw

typing the F10 key prints in the mini-buffer:

"Wrong type argument: window-live-p, #<frame F1 0x736800>"

(instead F10 should give the File-menu).

Starting Emacs

emacs &

in X-shell and typing F10 gives the correct behaviour, i.e. it opens the
File-menu.
