I'm not sure if it will work... but just ask for Yoshinori Okuji for a call of a interrupt of the bios that tells the bios: "Hey this is an incorrect boot" and then the bios tries to boot the next device in the bios boot list.

I've read some messages about someone advising Okuji to include this feature in grub2. I do not know if he has done it. If he has a piece of code of grub2 I could try to integrate it to Grub Legacy, compile it and send to you a compiled version.
