That's not guaranteed, is it? I'd think every theme would still need a license. And that goes for all it's content. I just sampled the PitchDark theme: the CSS files seem to have the Mozilla triple license block, but the images don't have any license. That means default copyright applies to them and, strictly, they're not even free to copy and redistribute. I'm sure this is unintended, but proper copyright statements are something to encourage. Because it also means, as al3xu5 pointed out, that such themes have no place in a free distribution.
