Bug wasn't fixed with the patch provided. However, Emacs 24.3.91 contained the solution to my issue

em-prompt.el

 (add-text-properties 0 (length prompt)
'(read-only t
 font-lock-face eshell-prompt
 front-sticky (font-lock-face read-only)
 rear-nonsticky (font-lock-face read-only))
