Yes, the check was added in 1.11.23:
$ cd /tmp
$ cvs version
Concurrent Versions System (CVS) 1.11.23 (client/server)
$ mkdir CVSROOT
$ cvs -d /tmp/CVSROOT init
cvs [init aborted]: Cannot initialize repository under existing
CVSROOT: `/tmp'
