Follow-up Comment #4:

This is an issue with gnuplot 4.2.6.  I also run Ubuntu 10.04 and I have both
gnuplot 4.2.6 and gnuplot 4.4.0 installed.  An "outside" legend works with
4.4.0 but not with 4.2.6.

Try installing a newer version of gnuplot through a ppa or downloading and
building from source to resolve the issue.
