Update of bug #31615 (project octave):
Status: Confirmed => Fixed

Follow-up Comment #1:
Some testing showed that although
cat (3, [], [], 1)
works in Matlab,
cat (3, cat ([], []), 1)
does not. So this looks like a special case. I checked in the following
change:

It seems to fix the reported problem for me, and also detects the error for
the second case above, so I'm closing this report.
