Follow-up Comment #9, bug #29057 (project octave):

Soren sees no markers in the figure neither, so the fact that "the markers"
are "missing" from the legend is a moot point. He should run code that
produces markers in the figure, then see if they ALSO show in the legend.

Also, as my example uses "~", which is an Octave feature, that automatically
cycles through different markers, maybe the Matlab behavior is less
significant?

Also, as my originally included modified __errplot__.m demonstrates, gnuplot
is perfectly capable to reproduce markers both in the lines and the legend.

So, no, in my opinion the bug is not closed. I'd propose you close this bug
as soon as you give a counter-example that has different markers on each
errorbar line, and also reproduces those markers on the legend. I'd be happy
to change my code instead of changing Octave.
