This indicates that the most recent version in the RCS file does not
have a state of "dead", which probably means that it was removed by an
old version of CVS that didn't set the state.  If so, I'd suggest
manually moving it out of the Attic, checking it out, and then removing
it with your current version of CVS.  Then you should be able to add
your new file with the same name.
