Free speech is still free. We can speak of Nintendo trademarks, as we do
now. Nobody forbids it.

The delivery of confusingly similar "goods and services" in connection
with the mark, that is confusingly similar to the registered or
protected trademark (as it does not need to be registered in every
country) is the infringement and legal danger for software distribution.

So, not the speech, the delivery, or making it available for others to
copy, and distribute.
