The gNewSense distribution is an aggregate and does not fall under the GPL as a whole. Background images are separate from any software or other artwork. Works such as themes can be considered as derivatives from the software they apply to in some circumstances and so would need a license that's compatible with that piece of software.
So if there are problems, they're not with gNewSense as a whole. There might be issues with compatibility between software and artwork or between several pieces of artwork (e.g. GPL'ed logo with other copyleft images).
