The key provision is:

“limit governments’ ability to require disclosure of proprietary computer source code and algorithms, to better protect the competitiveness of digital suppliers”

Once the corporate lawyers get hold of this, it will mean that if an agency chooses free software on the grounds that they will get access to the source code, they will risk being sued for discrimination by proprietary competitors.
