This problem doesn't sound familar and I can't reproduce it on my
system, but there are no keywords in my archives.  If you can provide a
test case for sanity.sh which reliably reproduces the problem using the
most recent stable or feature release of CVS, someone will look into
it.  The TESTS file in the sources and src/sanity.sh itself contain
instructions on writing tests.

This fix was made between 1.11.6 & 1.11.7.  From the NEWS file:

* Some minor corrections were made to the diff code to keep diff & rdiff
from
printing diff headers with empty change texts when two files have different
revision numbers but the same content.
