That patch applies to copy.c from coreutils-5.94 fine for me:

  $ patch < mv-rename-vs-unlink.diff
  patching file copy.c
  Hunk #1 succeeded at 1165 (offset -65 lines).

Any version of GNU patch should work:
  $ patch --version|head -1
  patch 2.5.9

Be sure not to change the tabs, spaces, or line endings
in the patch if you copy it from the message.
