And also say what operating system this is (uname -a) and if possible

Can you show us an example of the permissions that prevent the
preserve from working?
Example of a small test case: (this one is normal behavior)
mkdir /tmp/mytrial
cd /tmp/mytrial
touch foo
chmod a-rwx foo
ls -ldog foo
---------- 1 0 2005-07-19 22:30 foo
cp -p foo bar
cp: cannot open `foo' for reading: Permission denied
